Legal Questions About Parramatta & New South Wales
What is the stamp duty for property purchases in New South Wales?
NSW charges transfer duty on property purchases, calculated on the greater of the purchase price or the market value. Foreign purchasers pay an additional surcharge purchaser duty of 8% on residential property. First home buyers may be eligible for full or partial exemptions under the First Home Buyer Assistance Scheme. Collins Quarters advises buyers on duty obligations and available concessions before exchange of contracts.
How are commercial disputes resolved in New South Wales?
NSW courts have a tiered structure. The Local Court handles claims up to $100,000. The District Court manages disputes from $100,000 to $750,000. The Supreme Court of NSW deals with matters above $750,000 or those requiring equitable remedies. The NSW Civil and Administrative Tribunal (NCAT) handles tenancy, consumer, and strata disputes. The Federal Court also sits in Sydney for matters involving Corporations Act, competition law, and migration.
What consents are needed before selling property in NSW?
In NSW, most property sales require a vendor to provide a Section 66W Certificate (waiver of cooling-off rights) or allow a five-business-day cooling-off period. The vendor must also prepare a contract of sale that includes certain prescribed documents, including title documents, zoning certificates, and drainage diagrams. Off-the-plan contracts have additional disclosure requirements. Our team prepares and reviews contracts to ensure full NSW compliance.
